Terms of sale

1. Who you are dealing with

These terms apply to every piece we design and make for you. "We" and "us" mean Leumier & Co (ABN 90 719 661 572). "You" means the person commissioning the piece. Placing a deposit means you accept these terms.

2. Quotes and commissions

Every piece is made to order. We will give you a written quote covering the design, the stone and the metal before anything begins. A quote holds for [number of days to confirm] days, because diamond and metal prices move.

To confirm: how long a quote stays valid.

Your piece is only confirmed once you have approved the design and paid a deposit.

3. Deposit and payment

We take a deposit to confirm your order and begin work. The balance is payable before delivery.

To confirm: deposit amount or percentage, accepted payment methods, and when the balance falls due.

4. Lead time

Our usual lead time is six to eight weeks from the date your deposit is received, not from your first enquiry. This is an estimate made in good faith. Sourcing a particular stone, or a change you request partway through, can extend it. We will tell you as soon as we know if a date is going to move.

5. Changes and cancellation

You can change the design freely up until we begin making the piece. After that, changes may not be possible, and where they are, they may carry an additional cost that we will quote before proceeding.

To confirm: what happens to the deposit if you cancel after work has started. This needs a clear, fair position, and it is the clause most likely to be disputed.

6. Returns

Because every piece is custom made to your design, we do not offer change-of-mind returns or refunds on commissioned work. Please take the time you need at the design stage. You will see sketches and a to-scale rendering before anything is made, and we will not finalise a design until you are happy with it.

This does not limit your rights under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under that law, and those rights cannot be signed away.

If a piece is faulty, not of acceptable quality, or does not match the design you approved, you are entitled to a repair, replacement or refund depending on how serious the problem is. Tell us and we will put it right.

7. Resizing

We include one complimentary resize per piece. Some designs, particularly those with stones set around the band, cannot be resized safely; we will tell you before you commit if that applies to your piece. Further resizes are quoted at cost.

8. Certification

Lab-grown diamonds are independently graded by IGI. Natural diamonds are independently graded by GIA. The certificate for your stone is supplied with your piece.

9. Insurance valuation

A written valuation for your insurer is provided on delivery. It is prepared for insurance purposes only. It is not a resale price, an appraisal of market value, or a guarantee of what the piece would fetch if sold.

10. Care and wear

Fine jewellery is not indestructible. Damage from knocks, wear, chemicals, sport or alteration by another jeweller is not covered by these terms. If something goes wrong, bring it to us and we will quote a repair.

What we collect

If you use the enquiry form on this site, we collect the details you type into it: your name, your email address, your phone number if you give one, what you tell us about the piece you have in mind, and, if you ask for a callback, your preferred day and time of day.

We also collect whatever you share with us afterwards by email, phone or in person while we design and make your piece.

The ring studio and your photos

The ring studio at design your ring runs entirely in your browser. If you upload a photo of your hand to try a design on, that photo is never sent to us and never leaves your device. It is held in your browser for the current visit only, it is not saved to our servers, and closing the tab discards it. The preview image you can download is created on your own device.

Your ring design choices are saved in your browser's local storage so your design is still there if you come back. That stays on your device too, and you can clear it from your browser settings. We only see a design if you choose to send it with an enquiry, or bring it to a consultation.

If we ever add server-side image processing, this page will say so before it is turned on, and we will ask your consent first.

Why we collect it

To reply to you, arrange a consultation, quote and make your piece, and keep a record of what we made so we can service it later. We do not use your details for anything else, and we do not sell them.

Where it is stored

The enquiry form is handled by Netlify Forms. Netlify receives your submission, stores it against this site, and emails it to us. Netlify is a United States company and may store this data on servers outside Australia. We then keep the enquiry in our own email.

To confirm: how long submissions are retained in Netlify, and who else at Leumier & Co can see them.

Who we share it with

Nobody, other than service providers we need in order to do the work, such as our email provider, our jeweller, and the laboratory that grades your stone. We do not share your details with advertisers.

Third parties on this site

This site loads fonts from Google Fonts, which means your browser contacts Google and Google will see your IP address. We do not control what Google does with it. The map is served from this site and contacts nobody. This site does not use advertising or tracking cookies.

To confirm: if analytics is added later, this section has to say so.

Seeing or correcting your details

Email hello@leumier.com.au and we will tell you what we hold, correct anything wrong, or delete it, unless we are required to keep it.

Complaints

Contact us first and we will try to sort it out. If you are not satisfied, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.
